ผู้ให้บริการและขอบเขต

ข้อกำหนดนี้ใช้กับ JingJing บริการของ Marveo Media Group OÜ. ติดต่อ: jingjing@marveo.io.

JingJing เป็นแพลตฟอร์ม content และ live-streaming สำหรับ viewers และ creators รวมถึง public pages, waitlist, accounts, profiles, live streams, chat, feed features, creator functions, internal credits และ wallet features.

เมื่อสมัคร เข้าสู่ระบบ หรือใช้ JingJing คุณยอมรับข้อกำหนดนี้.

อายุขั้นต่ำ

คุณต้องมีอายุอย่างน้อย 16 ปีเพื่อใช้ JingJing. Creator features ที่เกี่ยวกับ payouts, KYC, tax forms หรือ bank details ต้องเป็นผู้ใหญ่ตามกฎหมายและผ่าน verification.

บัญชี

คุณต้องให้ข้อมูลถูกต้องและรักษาความปลอดภัยบัญชี. ห้ามแชร์ credentials. โดยทั่วไปหนึ่งคนมีได้หนึ่งบัญชี.

การใช้งานที่ยอมรับได้

ห้ามใช้ JingJing สำหรับ illegal content, fraud, money laundering, sanctions evasion, hate, harassment, threats, sexual content involving minors, impersonation, scams, spam, infringement of IP or privacy rights, scraping, bots, reverse engineering, manipulation of rankings, viewers, referrals, credits, ledgers or payouts, หรือการขาย/โอน accounts และ credits นอกฟังก์ชันที่ JingJing อนุญาต.

Content และ Rights

คุณยังคงเป็นเจ้าของสิทธิใน content ที่ส่งเข้ามา. คุณให้ JingJing สิทธิแบบ non-exclusive, worldwide, transferable และ sublicensable เท่าที่จำเป็นเพื่อ host, store, transmit, display, moderate, adapt technically, include in feeds and streams และ process content เพื่อ product, safety และ support.

คุณส่งได้เฉพาะ content ที่คุณมีสิทธิใช้. Content ที่ผิดกฎหมายหรือละเมิดสิทธิอาจถูกลบและบัญชีอาจถูกจำกัด.

Live Streams และ Chat

Creators และ viewers รับผิดชอบพฤติกรรมของตัวเองใน streams, chat และ interactions. JingJing อาจ moderate, remove, restrict, label, demonetise หรือ suspend content เมื่อจำเป็นเพื่อบังคับใช้ข้อกำหนด ปกป้องผู้ใช้ ป้องกัน fraud หรือปฏิบัติตามกฎหมาย.

Creator Features

Creator features อาจต้อง approval, identity checks, tax information และกฎเพิ่มเติม. ไม่มีสิทธิเรียกร้องให้ได้รับ creator approval, reach, revenue, ranking หรือ monetisation features ถาวร.

Creators รับผิดชอบ taxes, filings, licenses, permissions และความถูกต้องตามกฎหมายของ content และ services ของตนเอง.

Bao

Bao คือ virtual credits ที่ซื้อด้วยเงินจริงและใช้ใน JingJing เพื่อส่ง gifts ให้ creators ใน live streams, PK battles หรือฟังก์ชัน support ที่คล้ายกัน.

Bao ไม่ใช่ currency, e-money, financial instrument, bank balance หรือ legal tender. Bao ไม่มีมูลค่าเป็นเงินนอก JingJing, ถอนเงินไม่ได้, ไม่มีดอกเบี้ย, โอนออกไม่ได้ และแลกกลับเป็น Chai, Glow, cash, crypto, vouchers หรือมูลค่าอื่นไม่ได้.

Bao ซื้อ items ไม่ได้ และใช้ได้เฉพาะ gift/support functions ที่ JingJing เปิดให้ใช้.

Glow

Glow คือ internal creator payout measure. เมื่อ creator ได้รับ Bao gifts, JingJing อาจ credit Glow ตาม platform rules ที่แสดง. กลไกมาตรฐานคือ 100 Bao ที่ถูก gift จะกลายเป็น 40 Glow สำหรับ creator ที่ได้รับ.

Glow ไม่ใช่ user money, tradable currency, e-money หรือ financial instrument. Glow เป็นข้อมูลบันทึกค่าตอบแทน creator. Payouts ใช้ได้เฉพาะ creators ที่ approved, เป็นผู้ใหญ่ และ verified ผ่าน Trolley หรือ payout partner อื่นที่ระบุ.

ขั้นต่ำการ payout คือ 4,200 Glow หรือ 42 EUR เว้นแต่ product จะแสดงอย่างอื่น. Payouts อาจมี checks, holds, fees, tax forms, sanctions screening, fraud review และ legal restrictions.

Chai

Chai คือ activity credit สำหรับ non-monetary in-app features เช่น items, crafting, Tide changes หรือ product mechanics อื่น. Chai ไม่มี cash value, ถอนเงินไม่ได้, แปลงเป็น Bao หรือ Glow ไม่ได้ และโอนออกนอกฟังก์ชัน JingJing ไม่ได้.

Purchases, Refunds และ Payouts

Web Bao purchases อาจดำเนินการผ่าน Lemon Squeezy. App-store purchases อาจดำเนินการผ่าน Apple, Google, RevenueCat หรือ store mechanisms ที่เกี่ยวข้อง. Prices, taxes, fees และ payment methods แสดงใน checkout.

Refunds เป็นไปตาม mandatory consumer law และกฎของ payment หรือ store provider. Bao ที่ใช้แล้วและ platform services ที่เกิดขึ้นแล้วโดยทั่วไป refund ไม่ได้ เว้นแต่กฎหมายบังคับกำหนดอย่างอื่น.

Creator payouts ดำเนินการผ่าน Trolley. JingJing ไม่ใช่ payment service provider, bank, e-money institution หรือ financial institution และไม่ถือ customer funds เป็น payment service.

Moderation, Suspension และ Termination

ผู้ใช้สามารถ report content ที่ผิดกฎหมายหรือผิดกฎใน product หรือส่งอีเมลถึง jingjing@marveo.io. JingJing อาจ suspend หรือ terminate accounts สำหรับ legal violations, abuse, fraud, security risks, payment issues หรือ serious community violations.

หลังปิดบัญชี unused Bao, Chai, status values และ platform benefits อาจหมดอายุ เว้นแต่ mandatory law กำหนดอย่างอื่น. Open creator payouts จะถูกจัดการหลัง review ตามข้อกำหนดนี้.

Availability และ Liability

JingJing อยู่ในช่วง early product และ launch phase. Features อาจเปลี่ยน เพิ่ม หยุดชั่วคราว หรือยุติ. เราไม่รับประกัน availability ต่อเนื่อง rankings creator revenue reach หรือ compatibility ถาวรกับอุปกรณ์ใด.

JingJing รับผิดโดยไม่จำกัดสำหรับ intent, gross negligence, injury to life, body or health, mandatory product liability และกรณีที่กฎหมายห้ามจำกัดความรับผิด. สำหรับ simple negligence เรารับผิดเฉพาะ breach of essential contractual duties และเฉพาะ foreseeable typical damage.

Consumer Disputes

สำหรับ consumers ที่พำนักใน Estonia และ traders ที่จดทะเบียนใน Estonia, Estonian Consumer Disputes Committee ที่ Consumer Protection and Technical Regulatory Authority (TTJA) อาจมีอำนาจเมื่อ contract dispute ไม่สามารถแก้ไขโดยตรงได้. สิทธิตามกฎหมายในการใช้ judicial หรือ out-of-court remedies ยังไม่ถูกกระทบ.

EU online dispute resolution platform เดิมยุติวันที่ 20 กรกฎาคม 2025 จึงไม่มี link ไปยัง platform นั้น.

Law, Changes และ Contact

ใช้กฎหมาย Republic of Estonia เว้นแต่ mandatory consumer protection rules ของประเทศที่คุณพำนักเป็นประจำจะมีผลเหนือกว่า. เราอาจอัปเดตข้อกำหนดนี้เมื่อฟีเจอร์ กฎหมาย security needs providers หรือ economic mechanics เปลี่ยน.
